Use of the App

• Prohibited Use: You agree not to:

  • Modify, reverse engineer, or tamper with any part of the App.
  • Upload or transmit viruses, malware, or harmful code.
  • Attempt to gain unauthorized access to the App or related systems.
  • Use automated systems (bots, spiders, etc.) to overload or disrupt the App.

Content

• User-Generated Content: The App may allow users to submit, upload, or share content, such as text, images, documents, or videos (“User Content”). By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute it as necessary to operate the App.
• Content Ownership: You retain intellectual property rights to your User Content. The Company does not claim ownership of your submissions.
• Content Responsibility: You are solely responsible for the content you submit. Do not upload content that is illegal, harmful, offensive, defamatory, or violates any third-party rights.
• Data Retention by Institution: If you are using the App as a parent or staff member of a nursery, preschool, or school, you acknowledge that your institution reserves the right to retain, store, or manage the content you submit in accordance with their own policies and contractual agreements with you. Your submissions may be accessed, archived, or deleted by the institution as part of their operational or regulatory obligations.

Intellectual Property

• Ownership: The Company owns all rights, title, and interest in and to the App, including all associated intellectual property rights.
• License: The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, or sell any part of the App without written permission.

Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you agree to our data practices as described in this document.

Third-Party Services

The App may include links or integrations with third-party services that are not controlled by the Company. The Company is not responsible for the content, policies, or practices of such third-party services. Your use of those services is at your own risk.

• No Warranty: The App is provided “as is” and “as available” without any warranties, express or implied. The Company does not guarantee uninterrupted or error-free service.
• Limitation of Liability: To the maximum extent permitted by law, the Company is not liable for any direct, indirect, incidental, consequential, or special damages resulting from your use of the App.

Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and their officers, employees, and agents from any claims, losses, or liabilities (including legal fees) arising from your use of the App or your violation of these Terms.

Termination

The Company may suspend or terminate your access to the App at any time without prior notice, particularly in cases of misuse or violation of these Terms. Upon termination, your rights to use the App will immediately cease.

Additionally, the nursery also reserves the right to terminate or close your account as a staff member or parent in accordance with their own internal policies, procedures, and contractual agreements with you.

Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to any conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
